Tom Delay has to stay on the ballot in 22
Christmas comes early to the Lampson campaign!
Sparks' order prevents state Republican Chairwoman Tina Benkiser from completing the process of naming a DeLay successor. Although the Republican Party is expected to appeal, Sparks' order keeps the campaigns of possible GOP candidates for congressional District 22 in limbo.

The Findings of Fact/Conclusions of Law outlining the court's reasoning is a Sam Sparks classic. Very blunt. There is a link at Quorum Report (sorry - me no speakada html)
My favorite part is the reference to the rough draft of the resignation letter, dated May 25th, which Tinky Binky testified arrived to her by fax on the next day. The court specifically noted that she testified to this notwithstanding the fax's dateline of "APR 30".
The money quote, though, is at the first line of the conclusion: "Political acumen, strategy, and MANUFACTURED EVIDENCE, even combined with a sound policy in mind, cannot override the Constitution." (emphasis added).

I like the part where Sparks called out DeLay on admitting he didn't know where he would be on Nov. 7th. This:
there is no evidence that DeLay will still be living in Virginia tomorrow, let alone on November 7, 2006, the only day that matters under the Qualification Clause of the United States Constitution. DeLay himself testified that he does not know what will happen with his life in November, stating only that he plans to continue living in Virginia ‘indefinitely.’
